Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and Thruhikers ("we," "us," or "our"), concerning your access to and use of the Thruhikers website and services.

You agree that by accessing the Site and using our services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, you are prohibited from using the site and services and must discontinue use immediately.

Services Description

Thruhikers provides a platform for long-distance hikers to share their journey with supporters through SMS/MMS updates, interactive maps, photos, and other features. Our services are designed to work with limited connectivity and to facilitate communication between hikers and their support network.

Account Registration

To access certain features of the platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for:

• Maintaining the confidentiality of your account and password
• Restricting access to your computer or mobile device
• Accepting responsibility for all activities that occur under your account

User Content

Our services allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post, including its legality, reliability, and appropriateness.

By posting User Content, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through our services. You retain any and all of your rights to any User Content you submit, post, or display and you are responsible for protecting those rights.

You represent and warrant that:

• You own the content you post or have the right to use it and grant us the rights and license as provided in these Terms
• The posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person
• Your content does not contain any material that solicits personal information from anyone under 16 or exploit people under the age of 18 in a sexual or violent manner

Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make it available. As a user of the Site, you agree not to:

• Use the services in any manner that could disable, overburden, damage, or impair the site
• Use any robot, spider, or other automatic device to access the site
• Introduce any viruses, trojan horses, worms, or other material which is malicious or technologically harmful
• Attempt to gain unauthorized access to any portion of the site
• Harass, abuse, or harm another person through the platform
• Use the services for any illegal purpose or to violate any federal, state, local, or international law
• Impersonate or attempt to impersonate another user or person
• Collect or track the personal information of others
• Spam, phish, pharm, pretext, spider, crawl, or scrape
• Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the services

Fees and Payment

We offer both free and premium subscription plans. By selecting a premium plan, you agree to pay the subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for the subscription period indicated.

Unless you cancel your subscription before the end of the applicable subscription period, your subscription will automatically renew and you authorize us to collect the then-applicable subscription fee using any payment method we have on record for you.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

Limitation of Liability

In no event will we, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

Disclaimer

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that a) the service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the service is free of viruses or other harmful components; or d) the results of using the service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
